What is the European Accessibility Act?
The European Accessibility Act is the EU law that has, since 28 June 2025, required private companies in the EU to make their digital products and services accessible to people with disabilities. In Spain it is transposed as Act 11/2023. It applies to websites, apps, e-commerce and digital services, with fines of up to 1,000,000 euros under Act 11/2023.

Who must comply with the EAA?
The EAA applies to companies offering digital services: e-commerce, banking, insurance, transport, telecoms, online education and digital services in general. If your company invoices or serves customers in the EU through digital channels, it most likely applies to you.
Affected sectors
- E-commerce (any size)
- Online banking and insurance
- Telecoms
- Passenger transport
- Online education
- Digital consumer services
- Public bodies and publicly funded organisations
Microenterprise exemption
Microenterprises are exempt if both conditions are met:
Fewer than 10 employees
And less than 2,000,000 EUR annual turnover
The exemption disappears if you receive public funding or provide public services. The grey area is wider than it looks: many businesses think they are exempt and are not.

Shops with more than 100 products, interactive web applications, portals with authentication, sites with heavy dynamic or legacy content.
The remediation ranges are indicative estimates. The exact quote is delivered after the audit, with the full list of issues and their documented impact.

The EAA applies to companies offering digital services: e-commerce, banking, insurance, transport, telecoms, online education and digital services in general. Microenterprises (fewer than 10 employees and less than 2 million euros annual turnover) are exempt, unless they receive public funding or provide public services.
If your company is in a grey area, it is worth auditing before an inspection arrives. The microenterprise exemption has nuances that many advisors are not aware of.
